The North Sumatra High Prosecutor’s Office (Kejati Sumut) resolved a criminal case through restorative justice (RJ) from the Gunung Sitoli District Prosecutor’s Office after reviewing the request for case settlement.
The case was handled by the Deputy Chief Prosecutor of North Sumatra, Sofiyan S SH MH, accompanied by the Assistant for General Crimes (Aspidum) Jurist Precisely SH MH and heads of the general crime division, via an online meeting (Zoom) from the North Sumatra High Prosecutor’s Office meeting room to the Director of Criminal Prosecution at the Indonesian Attorney General’s Office, represented by Director C. The case was approved for a humane resolution through RJ.
The criminal incident occurred on Wednesday (2/4/2025) around 3:00 PM in Hiliduruwa Village, Sawo District, North Nias Regency, specifically at the home of witness Yohana Delima, alias Ina Ito. The suspect, Muliria Harefa, alias Ina Fifin, was the grandmother of the underage victim, Ayu Telaumbanua, alias Ayu.
The victim had come to receive a massage from witness Adewina Telaumbanua, alias Ina Yamo. At that time, the suspect ordered the victim, who was sitting in the living room, to move merchandise from the suspect’s house, located about 500 meters away.
However, the victim refused, citing lingering resentment over the suspect’s previous insults toward the victim’s mother, calling her a “prostitute.” This angered the suspect, leading to an argument with the victim.
Feeling disrespected, the suspect stood up and pulled the victim’s hair. The victim fought back by cursing at the suspect, further escalating the situation. The suspect attempted to attack the victim but was restrained by witness Adewina.
Overcome by anger, the suspect slapped the victim’s right cheek, pulled her hair, grabbed her from the front, and pushed her into a corner of the living room, causing minor scrapes on the victim’s body and shoulder.
Legal proceedings were initiated at the police station under Article 80 Paragraph (1) in conjunction with Article 76C of Law No. 35 of 2014, amending Law No. 23 of 2002 on Child Protection.
It was confirmed that after receiving the suspect and case files, the facilitator prosecutor at the Gunungsitoli District Prosecutor’s Office attempted mediation, considering the familial relationship between the suspect (grandmother) and the victim (granddaughter).
“The result was that the suspect and victim reconciled in front of investigators, witnessed by both families, who requested that the case not proceed to trial,” the statement explained.
It was further noted that resolving the case through RJ aligns with the goal of humane and fair legal justice, reflecting the prosecutor’s commitment to upholding ethical law enforcement.
“This approach is expected to maintain social harmony by prioritizing local wisdom within the community,” the statement concluded.
