Implementation Opinions on Strengthening the Management of Rural Housing Construction in Fengxian District
To thoroughly implement the spirit of the “Guiding Opinions on Strengthening the Management of Rural Housing Construction” (Document No. JCG [2024] 4) issued by the Ministry of Housing and Urban-Rural Development and other four departments, as well as the requirements of the “Measures for the Management of Rural Housing Construction in Shanghai” (Shanghai Government Order No. 16) and the “Guiding Opinions on Carrying Out Pilot Work for the Management of Rural Housing Construction Activities in the City” (Document No. HJCZ [2023] 432) issued by the Shanghai Housing and Urban-Rural Development Commission, and to further strengthen the quality and safety management of rural housing (hereinafter referred to as “farmhouses”) in our district, effectively safeguard the life and property safety of farmers, improve their living quality, and promote the establishment of a long-term mechanism for farmhouse construction management, the following implementation opinions are formulated based on the actual conditions of Fengxian District.
I. Clarifying Responsibilities for Rural Housing Construction Management
Strengthen the quality and safety supervision of farmhouse construction through multi-department collaboration, establish and improve a comprehensive management system for the entire process of rural housing land use, planning, construction, and usage, and guide all areas of the district to further enhance farmhouse management levels and construct high-quality, livable, and workable farmhouses.
(1) Implementing Primary Responsibility. The property owner of a farmhouse is the primary responsible person for the safety of the house and related construction safety, bearing the primary responsibility for house safety management and the implementation of construction protection measures. Units (individuals) involved in the use, design, construction, and material supply of farmhouses are the responsible entities for housing quality and safety management, each bearing corresponding responsibilities for housing quality and safety.
(2) Reinforcing Local Responsibility. The district people’s government is responsible for organizing and leading the management of farmhouse land use, planning, construction, usage, adjacent building relations, and construction safety within its jurisdiction. It shall formulate a comprehensive farmhouse management system tailored to local conditions, establish a regular management mechanism, ensure land supply and resource allocation, and fully implement farmhouse construction management responsibilities. Relevant departments of the district shall strengthen supervision and guidance for farmhouse construction and usage management according to their respective duties.
Town people’s governments (subdistrict offices) are specifically responsible for the management of farmhouse land use, planning, construction, and usage within their jurisdictions, including the approval of rural homestead land use, rural construction planning permits, style control, construction quality and safety supervision, completion acceptance, usage process control, verification and reporting of illegal activities, and the investigation and remediation of farmhouse safety hazards. They shall establish a whole-process supervision mechanism covering pre-approval review, on-site inspection, completion acceptance, and usage control, create farmhouse construction management archives with one file per household, and ensure standardized management.
Village-level organizations shall, under the guidance of town people’s governments (subdistrict offices), incorporate村民 housing construction management requirements into village regulations, assist村民 in handling rural housing construction approval procedures, establish a村民 housing construction coordinator system, and carry out self-governance management of村民 housing construction activities.
(3) Strengthening Department Coordination. Enhance inter-departmental coordination and collaboration. Adhere to the principle of “whoever approves, supervises; whoever is in charge, supervises” to ensure effective connection between administrative approval and safety supervision, refine supervision measures, strengthen supervision and management, and jointly ensure the safety of farmhouse land use, planning, construction, and usage management.
The district planning and resources department guides the planning layout of farmhouses, rural construction planning permits, and the organization, coordination, guidance, and supervision of rural geological disaster prevention.
