Interim Measures for the Flight Safety Management of Civil Unmanned Aircraft in Shanghai
Chapter I: General Provisions
Article 1 (Purpose and Basis)
These Measures are formulated to regulate the flight and related activities of civil unmanned aircraft within this Municipality, promote the healthy and orderly development of the unmanned aircraft industry, safeguard aviation safety, public safety, and national security, in accordance with the “Civil Aviation Law of the People’s Republic of China,” the “Interim Regulations on the Flight Management of Unmanned Aircraft,” the “Rules on the Operational Safety Management of Civil Unmanned Aircraft,” and other relevant provisions, and in light of the actual circumstances of this Municipality.
Article 2 (Scope of Application)
These Measures apply to the flight safety management of civil unmanned aircraft within the administrative area of this Municipality.
These Measures do not apply to the management of military unmanned aircraft, or unmanned aircraft under the jurisdiction of police, customs, or emergency management departments, nor to the indoor flight of civil unmanned aircraft.
Article 3 (Division of Responsibilities)
This Municipality shall establish a coordinated management mechanism with air traffic management agencies and civil aviation management departments to strengthen the management of civil unmanned aircraft.
The municipal transportation department, in accordance with the requirements of air traffic management agencies and civil aviation management departments, is responsible for coordinating the demand for the use of airspace for civil unmanned aircraft flights within this Municipality, collaboratively advancing the management of flight activities and flight service support, and implementing industry management over the municipal civil unmanned aircraft flight service agency (hereinafter referred to as the “Municipal Flight Service Agency”).
The municipal public security department is responsible for the public safety management of civil unmanned aircraft, participates in the management of flight activity declarations for civil unmanned aircraft, prevents and stops flight activities that endanger public safety, and conducts investigations and imposes corresponding dispositions for suspected illegal or non-compliant flight activities according to law.
The municipal economy and informatization department is responsible for the construction of information and communication infrastructure for civil unmanned aircraft, conducts radio management and unique product identification code registration inspections for civil unmanned aircraft, and guides the installation and use of radio countermeasure equipment.
The municipal data department is responsible for advancing the construction, operation, and maintenance of the Municipal Civil Unmanned Aircraft Flight Integrated Supervision and Service System (hereinafter referred to as the “Municipal Integrated Supervision and Service System”), coordinates the management of flight data for civil unmanned aircraft, and promotes the construction of the civil unmanned aircraft Internet of Things sensing system and the common capability support system of the “Low-Altitude Integrated Map.”
The municipal market supervision department is responsible for supervising and managing micro, light, and small civil unmanned aircraft systems in production, sales, and other links.
The municipal emergency management department is responsible for incorporating the safety emergency management of civil unmanned aircraft into the emergency management system for unexpected incidents and guides relevant departments in carrying out emergency management work.
The municipal development and reform, planning and resources, agriculture and rural affairs, culture and tourism, health, sports, urban management and law enforcement, fire and rescue, communications management, meteorology, and other departments shall perform work related to the flight safety management of civil unmanned aircraft according to their respective responsibilities.
District People’s Governments and their relevant departments are responsible for the management of civil unmanned aircraft within their respective administrative areas according to their division of responsibilities.
Article 4 (Municipal Flight Service Agency)
The Municipal Flight Service Agency, in accordance with the requirements of air traffic management agencies, civil aviation management departments, and this Municipality, and relying on the Municipal Integrated Supervision and Service System, provides flight activity acceptance services through the “Suishenban” platform, and cooperates with relevant departments and agencies in airspace management, situation monitoring, flight information, safety, and emergency response.
Staff of the Municipal Flight Service Agency shall undergo professional training; personnel engaged in air traffic control, flight information, aviation meteorology, and other specialties shall obtain corresponding qualifications according to law.
