How should responsibility be determined when fans insult and defame others while following celebrities? Today, the Supreme People’s Court released the second topic in the series “Five Years of the Civil Code: Typical Cases” titled “Insisting on Judicial Services for the People, Better Protecting the Needs for a Good Life of the People”. This addresses issues such as the governance of fan culture and other hot topics, further promoting the Civil Code’s integration into the lives and hearts of the people.
Both parties are fans of different celebrities and users of a social media platform. After one party posted some negative content about the other party’s favored celebrity, the affected fan reported these posts successfully. In retaliation, the reported individuals began continuously posting content like “Suspect: [Name]” and revealing personal photos and social media links of the complainant. The posts attracted varying degrees of attention, including hundreds to tens of thousands of views, shares, likes, and comments. The complainant believed this to be an infringement of their right to reputation and sued for an apology and compensation for emotional distress.
